Terms and conditions

1. These General Terms and Conditions (hereinafter referred to as “Terms and Conditions”) apply to offline and online sales of products and services of the Seller, which is the company BODYWORX CZ, s.r.o., with registered office at Tobrucká 710/19, Prague 6, 160 00, ID No.: 05924707, registered in the Commercial Register maintained by the Municipal Court in Prague, Section C, Insert 273097, represented by the Managing Director Mgr. Lenka Riva Ryšková (hereinafter referred to as the “Seller”), i.e. transactions concluded with the Participant or the Buyer by means of remote communication, through the interface of the website https://sundoclub.cz

2. The Participant is a person interested in the object of purchase and by his/her registration and participation in the seminar (together and individually hereinafter referred to as the “On-site Event”) and/or participation in the online seminar (hereinafter referred to as the “Online Event” ) agrees to the terms and conditions set out below and undertakes to comply with them.

3. The Purchaser is a person interested in the subject matter of the purchase, which for the purposes of these Terms and Conditions are electronically provided audio/video recordings (collectively and individually referred to as “Digital Products”). By purchasing the subject of purchase, the Purchaser agrees to the terms and conditions set out below and undertakes to comply with them.

4. The amount of the course fee for On-Site Events and Online Events is formed according to the Price Act or by contract. The Provider is not subject to value added tax. The course fee is payable immediately, unless otherwise stated on the web interface or in the invoice. The Participant’s obligation to pay the subject price is only fulfilled when the total specified amount is credited to the Provider’s account. An apparent error in the valuation (e.g. due to a wrong display) is not a price determinant. If the participant has placed an order at this price, the provider shall immediately ask the participant to agree to the corresponding price. In case of disagreement or failure to agree within 3 days, the order is not considered binding.

5. The amount of payment for Digital Products is formed according to the Price Act or contractually. The Provider is not subject to value added tax. Payment is due immediately, unless otherwise stated on the web interface or in the invoice. The Buyer’s obligation to pay the subject price is only fulfilled when the total amount specified has been credited to the Provider’s account. An apparent error in the valuation (e.g. due to a wrong display) is not a price determinant. If the buyer has placed an order at this price, the provider is immediately asked to agree to the corresponding price. In case of disagreement or failure to agree within 3 days, the order is not considered binding.

6. ON-SITE ACTIONS
6.1 Registration and payment for ON-SITE ACTIONS
Application for an On-Site Event is made via the online form located on our website. Registration for the Event and payment of the Course Fee is made by one of the following methods:
6.1.1. on-site event with advance payment
Completing the online application form and submitting it creates a non-binding 14-day reservation for a place. The registration is bindingly confirmed by the payment of the specified advance payment of the course fee to our account, either by online payment or by payment on account, where the account number and variable symbol will be sent to the participant by e-mail after completing the online registration form.
6.1.2. on-site events with full payment of the course fee in advance
Completing the online application form and submitting it creates a non-binding 14-day reservation of a place. The registration is bindingly confirmed by payment of the full course fee to our account, either by online payment or by payment on account, whereby the account number and variable symbol will be sent to the participant by e-mail after completion of the online application form.
6.1.3. on-site events with payment of the course fee on the day of the event
Completing the online application form and submitting it creates a binding reservation of a place.
The course fee can be paid online or in full in cash on the day of the Event, preferably within 15 minutes before the start of the Event.

6.2 Cancellation Policy for ON-SITE EVENTS
6.2.1 On-site Events with full payment of the course fee in advance
If a participant cancels EARLY than 30 days before the start of the Event, the full course fee paid will be refunded.
If the Participant cancels LESS than 30 days before the start (or during or after the end) of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the full amount of the deposit paid is non-refundable and non-transferable to another Event, but the remaining tuition fee will be refunded to the Participant (the amount of the deposit is always specified for each seminar).
A substitute may take the place of the participant upon prior notification. The substitute is provided by the participant.
6.2.2 On-site events with advance payment
If the participant cancels EARLY than 30 days before the start of the Event, the deposit paid will be refunded in the full amount of the payment received.
If the Participant cancels LESS than 30 days before the start (or during or after the end) of the Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the deposit paid in full is non-refundable and non-transferable to another Event. Upon prior notice, the Participant may be replaced by his/her substitute. The substitute will be provided by the Participant.

6.3 Prohibition to record the Event on site
The Participant may not, without the Provider’s prior consent, make an audiovisual, sound or other recording of the Event on the spot or otherwise copy or distribute the content of the Event, data about its participants, etc.

6.4 Costs associated with the cancellation of the on-site Event
The Provider shall not reimburse the Participant for any costs associated with the cancellation of the Event.

7. Online Events
7.1 Registration and payment for Online Events
Application for Online Events is made via the online form located on our website.
Registration for an Online Event and payment of the course fee is made in one of the following ways:
7.1.1.
Completing the online application form and submitting it creates a non-binding 14-day reservation for a place. The registration is bindingly confirmed by the payment of the specified advance payment of the course fee to our account, either by online payment or by payment on account, where the account number and variable symbol will be sent to the participant by e-mail after completing the online registration form.
7.1.2. Online events with full payment of the course fee in advance
Completing the online application form and submitting it creates a non-binding 14-day reservation of a place. The registration is bindingly confirmed by payment of the full course fee to our account, either by online payment or by payment on account, whereby the account number and variable symbol will be sent to the participant by e-mail after completing the online application form.

7.2 Cancellation Policy for Online Events
7.2.1.
If the participant cancels EARLY than 30 days before the start of the Online Event, the deposit paid will be refunded in full of the payment received.
If the Participant cancels LESS than 30 days before the start (or during or after the end) of the Online Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the deposit paid in full is non-refundable and non-transferable to another Online Event.
Upon prior notice, a substitute may take the place of the participant. The substitute is provided by the participant.
7.2.2. Online events with full payment of the course fee in advance
If a participant cancels EARLY than 30 days before the start of the Online Event, the full amount of the course fee received will be refunded. If a participant cancels LESS than 30 days before (or during or after) the start of the Online Event, either by his/her own decision or for unexpected reasons (e.g. illness or family matters), the deposit paid in full is non-refundable and
The remaining tuition fee will be refunded to the participant (the amount of the deposit is always specified for each Online Event).

7.3 Prohibition of recording the Online Event
The Participant may not, without the prior consent of the Provider, in any way
make an audiovisual, audio or other recording of the Online Event or otherwise copy or
disseminate the content of the Event, data about its participants, etc.

7.4 Costs associated with the cancellation of the Online Event:
The Provider shall not reimburse the Participant for any costs associated with the cancellation of the Online Event.

7.5 Claims of the Online Event due to technical failures on the part of the participant
The Provider shall not be liable for faults related to slow or faulty internet connection or insufficient software or hardware equipment of the Participant. In this case, the right to a refund of the course fee is forfeited.

7.6 Recording of the online event
In some cases, students are provided with a recording of the Online Event. The access data to the Online Event Recording is for the personal use of the participant only and it is forbidden to allow access to third parties.

8. DIGITAL PRODUCTS (Video courses and recordings)

8.1 Ordering, payment and access for DIGITAL PRODUCTS
Orders for Digital Products are placed through the online form located on our website.
8.2 Payment and delivery of access to Digital Products:
The Buyer has the option in the order to choose the form of payment by credit card through an online payment gateway or by bank transfer.
In the case of payment by bank transfer, the Buyer will receive the account number and variable symbol by email after the online order has been submitted.
Access data or download links are sent to the buyer by email within 3 days after receipt of payment. In the case of payment by credit card, the delivery time of the accesses is linked to the automatic processing of the receipt of payment and the buyer receives the accesses to the Digital Product immediately.

8.3 Duration of accesses and copyright protection for the Digital Product
Access to the audio/video recording is provided via a web browser and is available to the Purchaser from the time of payment for the period specified in the description of the Digital Product.
The access data and download links are for the personal use of the purchaser only and it is prohibited to allow access to third parties, including sharing on social networks. Should this be the case, the provider has the right to withdraw from the purchase contract, deactivate the buyer’s access data and recover any lost profits or damages incurred. The buyer is also obliged to prevent the misuse of his/her access data by third parties.

6. Cancellation conditions for DIGITAL PRODUCTS and money-back guarantee
The Buyer has the right to withdraw from the Purchase Agreement within 30 days of payment for the Digital Product. To withdraw from the Purchase Agreement, the Buyer shall send an email to the Provider at hello@sundoclub.cz.

Other arrangements
9. Health and liability
9.1 Health
All offline and online products are not a substitute for medical or psychotherapeutic care. In the event that the Participant is currently undergoing any kind of treatment (especially psychiatric or psychological work), the Participant undertakes to inform the Lecturer of this fact and the nature of the difficulties or treatment prior to the Event. The Participant further undertakes to inform the Tutor of any possible medical complications (post-traumatic conditions, long-term illnesses, epilepsy, asthma, pregnancy, etc.). The Participant declares that he/she is not taking psychopharmaceuticals or other psychoactive substances. In case of participation in the Event on site, the Participant declares that he/she has no infectious diseases.

9.2 Prohibition of drugs and narcotics
The Participant declares that he/she acknowledges that it is prohibited to participate in the Event under the influence of drugs or other addictive, narcotic or psychoactive substances and undertakes not to use them before and during the Event.

9.3 Liability
Participation in the Event is voluntary. The Participant is fully responsible for himself and for all his actions throughout the duration of the programme. Instructions from the lecturer are only suggestions to be followed at the participant’s own discretion. The Participant acknowledges that he/she may be subjected to physical, mental or emotional stress during the Event.
Participants under the age of eighteen (18) must have the prior written consent of a legal guardian or custodian to participate in the Event.
Neither the Provider nor the trainer or therapist is in any way responsible for the consequences that may arise for the Participant or third parties in the application of the advice and recommendations presented during the Event or the Digital Product.

9.4 Interruption of participation
The Participant may leave the Promotion at any time at his/her own risk, knowing that the fee for the Promotion is non-refundable. It is the right of the Lecturer to terminate the Participant’s participation in the Event if it deems it appropriate to do so, having particular regard to the safety of the Participant and/or other participants in the Event. In this case, the Event fee will be refunded.

10. Processing of personal data and consent to the processing of personal data
10.1 All processing of personal data is carried out in accordance with the Personal Data Processing Policy
which are in accordance with the applicable legislation.

10.2 The Subscriber acknowledges that the provision of their personal data to the extent set out in the Personal Data Processing Policy is a contractual requirement necessary for the provision of the Service. Its provision is a matter of the Subscriber’s personal will, and without the provision of personal data to the extent required, the Service cannot be properly provided.

11. Use of cookies on the sundoclub.cz website
The use of cookies is specified in the Privacy Policy.
